Terms and Conditions Velk Hiring

The terms and conditions of rental set out hereunder shall apply to all items rented by us or on our behalf.

1. Ownership of the rented item/s shall at all times remain vested in Velk Hiring (hereafter referred to as the owner). The hirer will not sell, hire out/lend, part with possession thereof, or encumber/assign any right/interest in the hired item/s.
2. The hirer accepts full responsibility for any damage to or loss of the owner’s equipment occurring whilst in his/her possession. The possession will be in effect until the item/s have been returned and inspected by the owner on the owner’s premises. It will be the sole discretion of the owner to make a decision as to whether the hired item/s are damaged or not fit for the purpose for which it is intended.
3. The hirer shall indemnify the owner completely against any party for any damaged of any nature whatsoever (or injury to persons or damage to property caused by the hired item/s and additionally in respect of all costs/charges in connection therewith, whether this arises under common law or statute law.
4. Hiring will commence at the time of collection/delivery and will continue up to when the hired item/s are returned to the owner. The hired item/s will only be viewed as being returned when they have been inspected by the owner and are in an acceptable condition.
5. Hired item/s which are not returned before 12:00 the day after the rental expires, will incur the charging of one day’s rental.
6. Hired item/s which is not returned will be charged for in accordance with the new replacement purchase price. Velk Hiring will continue to charge rental up to the time the hired item/s are returned or fully paid for.
7. In the event of rental items being delivered by the owner in the absence of the hirer/his representative, the order form/delivery form/signed invoice will serve as proof that the rental item/s listed have been delivered in working order. The signing of a delivery note by the hirer/his representative on site shall serve as proof that the items were in good order.
8. 1. A booking fee of 10% of hire costs will be made for orders cancelled more than 24 hours prior to the time of collection.
   2. A fee of 33% of hire charges will be made for orders which are cancelled less than 24 hours before date/time of collection.
   3. The full hire charge is payable notwithstanding that goods hired are returned prior to due date for return.
9. In the event of the hirer contravening any of the above conditions, it will be within the owner’s rights to have access to any location so as to repossess any rental items immediately the hirer shall be entitled to cancel the hire contract. The hirer may claim hire charges up to cancellation date and further damages, including, but not limited to, an amount equal to what would have been paid as hire charges, had the hire contract run its full period.
10. Unless agreed in writing all hire charges shall be paid in full before delivery. All rental item/s will carry an additional refundable deposit amount at the owner’s discretion, as to cover the replacement cost of any rental items. The deposit shall also be paid prior to delivery/collection of the rental items and will be refunded after Velk Hiring has had a reasonable time so as to inspect the returned item/s, but a deposit or a portion thereof may be retained in the event of rental item/s being damaged of lost.
11. The rental item/s shall be deemed to be in good working order and fit for the purpose for which it is intended when delivered to the hirer, unless the hirer notifies the owner of any defects immediately upon taking delivery.
12. The hirer acknowledges that he/she is aware of the purpose for which the rental item/s is designed as well as all maintenance and safety procedure’s required with regard to the rental item/s. The hirer will use the rental item for this purpose only and will follow all safety/maintenance procedures.
13. It is expressly recorded that the hirer does not warrant that the goods are suitable for the purpose for which they have been hired.
14. The hirer is advised to consider his/her own insurance cover on rental item/s not on the owner’s premises and therefor will be covered against unforeseen circumstances.
15. The cost of delivery/collection is not included in the hire charge unless agreed in writing.
16. The hirer shall be liable for all reasonable costs incurred by Velk Hiring which should arise from any breach of these terms and conditions by the hirer. These costs would include transportation costs, storage costs and legal costs.
17. In the event of any cause of action, the hirer will consent to the jurisdiction of any Magistrate’s court.
18. These terms and conditions may not be waived, amended, altered or cancelled, unless reduced to writing and signed by the owner.
